A 24-year-old man pleaded not guilty today in the High Court in Banjul to a single count of rape involving a 10-year-old girl, in a case that has underscored the judiciary’s commitment to protecting child victims.
Presided over by Justice Ebrima Jaiteh, the proceedings saw the State represented by prosecutor M. Sarr, while J. Jeng appeared for the accused. The charge is brought under Section 3(1)(a) of the Sexual Offences Act, 2013, and is punishable under Section 4(1)(a)(iii)(bb) of the same law.
According to the allegations, the incident occurred on October 12, 2025, when the accused allegedly intentionally engaged in a sexual act with the minor. Prosecutor M. Sarr emphasized to the court that the victim is a child, urging strict non-disclosure of her identity to safeguard her privacy.
In a detailed ruling, Justice Jaiteh affirmed the court’s legal and moral obligation to shield the alleged victim’s identity. He described the protection of children in judicial processes as a fundamental principle, aimed at preserving their dignity, privacy, psychological health, and overall best interests.
Public identification of child victims in such sensitive cases risks causing stigma, emotional trauma, and long-term social harm, the judge noted. This stance aligns with international standards, particularly the United Nations Convention on the Rights of the Child, which prioritizes the best interests of the child in all relevant actions.
Justice Jaiteh invoked the court’s inherent powers to ensure the administration of justice and the protection of vulnerable individuals. He ordered that the child’s name and any identifying details remain undisclosed in the judgment, public records, or any related proceedings. For reference purposes, she will be referred to only as “Child A.”
The judge directed all parties, legal counsel, and media personnel covering the case to strictly comply with the order, prohibiting the publication or dissemination of any information that could reveal the child’s identity.
The matter has been adjourned to March 23, 2026, at 1:00 PM for further hearings.
