State’s Appeal Over Police Killings Acquittal Threatened by Legal Objection

The Court of Appeal has set strict timelines for legal filings after the second respondent, Amie Bojang, filed a preliminary objection challenging the State’s appeal against the acquittal of the Bojang siblings in the high-profile murder of two police officers.

Presided over by Justices N. Salla-Wadda, Basiru V.P. Mahoney, and Amina Saho-Ceesay, the court on Monday directed the Second Respondent to file her brief on points of law and arguments within seven days. The State, as Appellant, was granted seven days to respond to the preliminary objection, with the Second Respondent allowed an additional three days for a further reply.

The development stems from a Notice of Preliminary Objection lodged by Amie Bojang through her counsel, L.K. Mboge of Maritang Chambers. The objection seeks to dismiss the State’s appeal in its entirety, arguing that the appeal is incompetent and that the court lacks jurisdiction to entertain it or the related motion filed on 29 April 2026.

According to the notice, the State failed to attach a copy of the judgment it is appealing against and did not obtain the required leave from either the High Court or the Court of Appeal, despite leave being a mandatory condition precedent. Counsel indicated that additional grounds of objection may be raised during the hearing.

Appearing for the State were A. Badjie and F. Touray and B.M.O. Badjie held brief for L.J. Darboe, representing the first respondent, Ousainou Bojang, while L.K. Mboge represented Amie Bojang.

The High Court acquitted the Bojang siblings on charges related to the killing of two police officers, a case that had drawn significant public attention. The State’s decision to appeal the acquittal has now been thrown into uncertainty by the procedural challenge.

The matter has been adjourned to Monday, 13th July 2026, at 10:00 a.m. for further proceedings.
